I’ll probably get in trouble for saying this but I think the “offender” should be the one that “pays the price” (even though in our house I’m probably the “offender” more often than my DH)

You won’t get in trouble. He would be the first to agree. The fact is that he’s fast asleep and I’m awake. So I’m going to wake him up and send him elsewhere? You don’t stay married for 30 years with that kind of attitude

There are also some other “prices” that can be paid (cooking breakfast, a massage etc) that probably wouldn’t be quite as “harmful” :).
